Oman Gratuity Calculator: the new one-month rate, split correctly for older service

Oman's new Labour Law doubled the gratuity for expatriates' first three years. Since 26 July 2023 it is one month's basic wage for every year. Service before that date keeps the old rate of 15 days a year for the first three years, so long-serving staff need a split calculation. Enter your real dates and the calculator splits it for you.

Calculate your Oman gratuity

Basic wage only; allowances are excluded.

Estimated end-of-service gratuityOMR 3,803.014≈ ₹9,48,472 · 6.338 months of wage

How this number was calculated

  1. Service counted2,861 days − 0 unpaid = 2,861 days (7 yrs 10 mths 6 days) = 7.838 years
  2. Before 26 Jul 2023, years 0–30.5 month × 3 yrs = 1.5 months
  3. Before 26 Jul 2023, years 3–4.5671 month × 1.567 yrs = 1.567 months
  4. From 26 Jul 2023, years 0–3.2711 month × 3.271 yrs = 3.271 months
  5. Full awardOMR 600.000 × 6.338 = OMR 3,803.014

Estimate of the legal minimum only. Contracts and company policies can pay more, employers may deduct amounts you owe, and free-zone or government employers can follow different rules. Not legal advice.

Oman gratuity formula and who qualifies

Gratuity = basic × [old-law months for service before 26 Jul 2023] + basic × 1 × years since 26 Jul 2023

Worked example: OMR 600.000 a month, 7½ years, contract ended by the employer

7.5 years × 1.00 month = 7.500 months of wage. OMR 600.000 × 7.500 = OMR 4,500.000.

How the Omani rules treat each situation
SituationMinimum serviceWhat is paid
Service from 26 July 2023None1 month's basic per year, pro rata
Service before 26 July 2023, first 3 years—15 days (½ month) per year
Service before 26 July 2023, after year 3—1 month per year
Resignation—No reduction
Dismissal without notice under Article 40AnyNo gratuity
After the savings system starts (by 19 July 2027)—Employer pays 9% of basic monthly into the fund instead

Claim vs reality: does Oman's new law double everyone's gratuity?

Finding: no. It doubles the rate only for years 1–3 and only for service from 26 July 2023; years 4 onwards were already one month. For someone who joined in 2018, the new law adds nothing to their first five years, which stay on the old basis. The gain is largest for people who joined after mid-2023.

Calculated by KalQLater from the articles cited below. UAE figures use Article 51 of Federal Decree-Law No. 33 of 2021. Wage definitions differ: Oman's base is described in the calculator, the UAE's is basic salary only, so equal months do not mean equal money. Oman figures assume all service is after 26 July 2023; use the calculator with real dates for earlier service.

Methodology and limitations

Service is counted in calendar days between your joining date and last working day, inclusive, minus unpaid days, and converted to years at 365 days. Each band of service is multiplied by its statutory rate in months of wage, then any cap and resignation fraction is applied. Part years are pro rata where the law allows it.

  • Omani nationals are covered by the Social Protection Fund, not this gratuity.
  • The savings system (Social Protection Law, Royal Decree 52/2023, Articles 137–139, amended by Royal Decree 60/2025) will replace employer-paid gratuity for non-Omanis, funded by 9% of basic wage a month. Gratuity earned before it starts remains payable.
  • Unpaid special leave and childcare leave are excluded from service.
  • We could not open the official qanoon.om text on the verification date; the rule is confirmed by the Ministry of Labour circular reported in August 2026 and by PwC's analysis of the law.

Not modelled: contractual terms better than the law, free-zone or government schemes, deductions for amounts owed, and court or settlement outcomes. Results are estimates, not legal advice.

Oman gratuity FAQs

How is gratuity calculated in Oman under the new Labour Law?

For service from 26 July 2023, Royal Decree 53/2023 (Article 61) gives at least one month's basic wage for each year of service, pro rata for part years. Service before that date is calculated under the old law: 15 days' basic per year for the first three years and one month per year after.

Do I need one year of service for gratuity in Oman?

Not under the new law. Part years are paid pro rata, so service under one year earns a proportional gratuity. The repealed law required one year.

Do I lose gratuity if I resign in Oman?

No. The new law does not reduce gratuity for resignation. It is lost only on dismissal without notice under Article 40.

When does Oman's savings system replace gratuity?

The Social Protection Fund board sets the start date, which must be no later than 19 July 2027 after Royal Decree 60/2025 extended it. Once it starts, employers pay 9% of expatriates' basic wage monthly into the fund. Gratuity for earlier service is still owed.

When must gratuity be paid in Oman?

With final dues when employment ends; reported guidance gives seven days where the worker left voluntarily.
